    To obtain a building permit for a garden suite, it must meet Ontario Building Code regulations, including:

    1. Emergency Access:

    • The entrance must be within 45 metres of a public street.
    • A clear path of at least 1.0 metres wide and 2.1 metres high must connect the suite to the street. Only hydro and gas meters may obstruct this space.

    2. Tree Protection:

    • The construction of a garden suite must not involve the removal of healthy trees protected under municipal bylaws.

    3. Size Limitations:

    • The footprint of a garden suite cannot exceed 40% of the rear yard area or 60 square metres, whichever is smaller.
    • The total interior floor area must be smaller than the main house.

    4. Setback Requirements:

    • The side yard setback must be at least 0.6 metres or 10% of the lot frontage, up to a maximum of 3.0 metres.

    Example: If your backyard is 1,351 square feet, a garden suite can occupy up to 540.4 square feet (50.21 square metres) based on the 40% rule.

    When applying for an garden suite permit, you’ll need to provide the following documents:

    • Site Plan: A current survey or site plan indicating property lines, lot area, any right-of-way or easements, and the location of both existing and proposed buildings. Ensure all setback dimensions to property lines and adjacent structures are included.
    • Zoning Summary: Outline permitted and proposed zoning provisions, including lot area, building area (GFA), coverage, and grade elevations to confirm height.
    • Parking and Landscaping Details: Show the dimensions of parking areas, driveways, and any hard or soft landscaping, along with any other accessory structures.
    • Building Details: Include floor plans, elevations, sections, and construction details, such as concrete slab specifications (strength, reinforcement), and detailed building materials and specifications for walls, floors, and roofs.
    • Guard Details: Provide details on guards, including connection methods.

    Ontario offers a 15-year forgivable loan of up to $30,000 to help homeowners build a garden suite or secondary unit. Funds are limited and awarded on a first-come, first-served basis, with priority given to projects ready for immediate construction.

    Yes, you can apply for an agarden suite permit online through the Toronto Building’s Express web application portal. This platform allows you to view required documents, check for any necessary external approvals, and track your application from start to finish. Note that this service excludes permits for laneway and garden suites.

    • Up to 4.0 metres if the suite is at least 5.0 metres from the main house.
    • Up to 6.0 metres if the suite is at least 7.5 metres from the main house.
